AGREEMENT
Lightspeed is and interactive online service provider. This agreement sets forth the Standard Terms and Conditions that apply to the subscriber use of Lightspeed. Subscriber hence worth agrees to compliance with all terms of service use.
RELATIONSHIP
The relationship between the subscriber and Lightspeed is that of subscriber and service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement. Lightspeed reserves the right to immediately terminate the services provided to the subscriber, with the subscriber being fully responsible for any and all attorney’s fees incurred by Lightspeed regarding this agreement at all trial and appellate court levels.
THE RESPONSIBLITIES OF USER
You agree that you will be the only user of your username and password and the you will not transfer or disclose either your username or password to any other person. A minor (persons under 18 years of age) can not be a user.
You agree not to transmit or publish on or over the Service any information, software or other content which violates or infringes upon the rights of others.
You agree to comply with all applicable laws, rules and regulations on connection with the Service.
You acknowledge and agree that you are aware that certain content, service, or locations of the Service or of other parties that may be accessible through the Service may contain material that is unsuitable for minors (persons under 18 years of age) and that the Service does not screen or censor such content with regard to copyright, obscenity, safety integrity, or reliability. You agree to supervise usage of the Service by any minors whom you permit to use the Service.
UNAUTHORIZED USE
Lightspeed has certain legal and ethical responsibilities with respect to the provision of the Services. Lightspeed, therefore, strictly prohibits system abuse, which includes, without limitation, the following actions, a) upload, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; b) harm minors in any way; c) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content through the Service; e) upload, post, email or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); f) upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; g) upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotions materials, “junk mail”. “spam”, “chain letters”, pyramid schemes”, or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose; h) upload, post, or email otherwise transmit an material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or cause limit functionality of any computer software or hardware or telecommunications equipment; i) disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges; j) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; k) intentionally or unintentionally violate any applicable local, state, national or international law; 1) “stalk” or otherwise harass another; or in) collect or store personal data about other users. Lightspeed may take such action as it deems appropriate against you for violations of the policies, including without limitations, removing any content that violates the Agreement, terminating this Agreement and your use of the Service, and cooperating with law enforcement officials by providing whatever information may be requested upon presentation by such officials of appropriate authorization form a court having jurisdiction over the subject matter. However there is no promise or obligation on out part to monitor or police any such activity and the Service will have no liability to any party for any other party’s violation of these policies.
Any subscriber attempting to harm or cause damage to Lightspeed equipment is any way will be billed at $250.00 per hour, with a minimum billable time period of 1 hour, to track the offending subscriber and repair any damage they may have caused.
Refunds for accounts closed due to a direct violation of the User Policy Agreement will only be grated at the discretion of Lightspeed.
SERVICE RATES; PAYMENTS; PENALTIES
The rates and charges for the Service shall be set forth on your Installation Agreement or otherwise in accordance with Lightspeed’s rate schedule which shall be provided to you upon request. Rates and charges, and other terms and conditions of the Service, are subject to change by Lightspeed from time to time by notice to you provided on the Service or otherwise.
Lightspeed will invoice you once a month in advance for usage of the Service, either directly by Lightspeed, through your designated credit card company or your bank as an automatic withdrawal. Your Service charges for a one month period starts on the first day of each month. You agree to pay the applicable fees as set forth on your invoice by the due date, and pay any interest or late fees incurred for late payment of the required fees.
a. In the event you do not pay the fees invoiced to you by the due date, the Service will be inaccessible to you until you pay all fees owed to Lightspeed as well as a reconnection fee.
b. Accounts shall automatically renew at the end of their term date. Payments not received within 30 days of invoicing will be
subject to a 1.5% financing charge.
BILLING DISPUTES
In case of any billing disputes, you must notify, in writing, Lightspeed no later then 60 days after the date the alleged billing error first arose, whether on invoice or a charge against your credit/debit card. Failure to do so will waive your right to further contest of the charge(s).
CANCELLATION POLICY
Charges are not prorated if you choose to cancel your account prior to the end of your billing period. You may elect to have your account closed at the end of the current billing cycle.
WARRANTY & LIABILITY
The Lightspeed Service is provided in an as is, as available, basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Lightspeed expressly disclaims any representation or warranty that the Lightspeed service will be error free, secure or uninterrupted. No oral advice or written information given by Lightspeed, its employees, licensors or agents will create a warranty; nor may you rely on any such information or advice. The terms of this section shall survive the termination of the
Agreement for whatever reason.
VIOLATIONS OF ACCEPTABLE USE POLICY
Lightspeed may take any one or more of the following actions in response to violations of this Acceptable Use Policy
* Suspend the customer’s account
* Terminate the customer’s account
* Deny the customer future service
* Bill the customer for administrative costs and/or reactivation charges, as appropriate
PRIVACY AND ACCEPTABLE USE
Lightspeed provides a gateway for the User to connect to the "Internet", and as such is acting as a "Common Carrier". Lightspeed has no control over the material on the "Internet". Some people may find certain material on the "Internet" objectionable. Lightspeed assumes no responsibility for any material found on the "Internet". Users are free to use any "Internet" service available as long as it is for LEGAL purposes. Any report of any illegal activity can cause immediate suspension of access and notification of the appropriate authorities. Lightspeed reserves the right to suspend or cancel any account at any time. Lightspeed will make available to law-enforcement agencies any User's account information as required by law or if it is necessary to protect Lightspeed’s equipment, staff, or other Users from service interruption or shutdown. In short, DO NOT ENGAGE IN ANY ILLEGAL ACTIVITY WHILE USING OUR SYSTEM! Lightspeed makes no claims or warranties about the security of Lightspeed’s system, User's files or User's email. Third-party encryption tools such as PGP and RSA can be used If a User needs to ensure privacy of a file or email message, although Valkyrie Internet has no affiliation with and makes no claims about the secureness of any encryption tool a User may choose.
Users should be aware of proper on-line etiquette (netiquette). Guidelines can be found in many "Internet"-related books, magazines, and newsgroups. A User will be held liable for any temporary or permanent damage done to Lightspeed’s system due to the User's negligence or lack of netiquette, whether intentional or accidental. This can include, but is not limited to, the release of computer viruses or worms, "cracking" into unauthorized areas on any system, or sending or causing the receipt of "email bombs" by Lightspeed’s system. A User engaged in any such damaging activity, as determined by Lightspeed, can have their account suspended or canceled, be billed for excessive bandwidth usage and system administrator's time, and be charged for any other damage or loss caused by User's actions. These situations will likely never be encountered by most Users, but it is important to be aware of the rules and consequences.
MODIFICATION OF TERMS
Lightspeed reserves the rights to modify this policy at any time and without advance notice.
